Michael Cohen is asking the Supreme Court to help him get Trump

Michael Cohen, the former attorney for former president Donald Trump, is asking the U.S. Supreme Court for some help. 

The Hill reports that Cohen wants the justices "to revive his claim seeking damages for retaliation during his prison sentence."

Cohen submitted the request to the high court on Wednesday, June 10, 2024. This all comes after Cohen was the star witness in the so-called hush-money case that resulted in a guilty conviction against Trump.

The former president, for his part, has yet to comment on Cohen's petition to the Supreme Court, but, as we will see, his attorney and his campaign spokesperson have.

Background

For those unfamiliar with what is going on, Cohen is essentially trying to claim that Trump ordered his imprisonment in retaliation for Cohen's decision to publish the book, Disloyal: A Memoir: The True Story of the Former Personal Attorney to President Donald J. Trump.

The Hill explains:

The dispute stems from Cohen’s criminal case. The former president’s ex-personal attorney was serving a three-year sentence after pleading guilty in 2018 to federal campaign finance and other crimes. Cohen maintains he committed some of them at Trump’s direction. When the COVID-19 pandemic hit, Cohen’s prison time was furloughed for health reasons that would be exacerbated by the virus. He was sent to home confinement.

Cohen, however, was later ordered back to prison, and Cohen is trying to claim that Trump ordered this as a retaliatory measure.

Fox News reports:

Cohen, former President Trump's controversial long-time lawyer and fixer, is asking the court to hear his claim that he was sent back behind bars, shackled, and placed in solitary confinement on the alleged orders of Trump and Justice Department officials in July 2020 in retaliation for his writing his first tell-all book, Disloyal: A Memoir: The True Story of the Former Personal Attorney to President Donald J. Trump.

Cohen has already the case at the lower court levels, which is why he is now asking the Supreme Court to step in.

"A disgruntled disgrace and a total loser"

Trump attorney Alina Habba has released a statement on the matter in which she said that Cohen's latest efforts against Trump will fail.

"Michael Cohen’s suit against the President was doomed from its very inception. Setting aside the fact that his allegations are meritless, the Supreme Court has already held, as recently as 2022, that Bivens suits in this context are not viable," she said.

Trump spokesman Steven Cheung has also released a statement on the matter, saying, "Michael Cohen is a disgruntled disgrace and a total loser. Nothing Mr. Cohen says can be trusted and now that his 15 minutes of fame have expired, he is more desperate than ever."

The question now is whether the Supreme Court will hear the case.

Four justices would have to give the okay for it to be heard.
