Kennedy Cleared for New Jersey Ballot in Presidential Election

Robert F. Kennedy Jr. has cleared one more hurdle to be a thorn in the side of Democrats.

Kennedy has been given the thumbs up to be placed on the New Jersey ballot in the upcoming election.

Kennedy would appear to be taking more votes from Harris than Trump, but his support is falling.

Too Late?

Kennedy started this election cycle out like a sprinter coming out of the blocks, but he is fizzling with every passing day.

At one point, he was around 12%, and he threatened to climb as high as 15% in some states.

The last polls I saw had him down around five or six percent, so I am not sure how much he will impact the race at this point.

Regardless, Kennedy will now be on the ballot, winning a challenge that wanted to disqualify him via the “sore loser” law.

Administrative Law Judge Ernest Bongiovanni ruled in Kennedy’s favor because he was never registered for the election in the state as a Democrat.

The law would prevent someone who lost a primary from running as an Independent just for spite.

The judge wrote, "Thus, the fact that Kennedy’s camp operated as Democrats for a few months in 2023, that is no proof that even intended to, much less actually participated in New Jersey’s primaries, nor as New Jersey write-in candidates.

"More significantly, respondents never filed nominating petitions to be primary candidates for the office of President and Vice President for the Democratic Primary election."

New Jersey election attorney Scott Salmon, a Democrat, was livid over the decision, stating, "Instead of just ruling that RFK didn't "unsuccessfully seek" the nomination, he ruled that the only way the Sore Loser Law would apply is if RFK actually submitted a nominating petition for the primary election.

"If that's true, then there is no point to the law ... because (it) expressly forbids independents who have previously submitted primary nominating petitions."

Forgive me if I don’t share your outrage, Mr. Salmon.
