Donald Trump Cases in Limbo After Immunity Ruling

Donald Trump has caught yet another break due to the Supreme Court immunity ruling.

As I had predicted, the court kicked the case back to the lower courts while regurgitating what we already know about presidential immunity.

The good news for Trump is that while this issue continues to flounder in the lower courts, Trump’s legal cases are all put on hold, which will allow him to freely campaign during the presidential election.

Good News for Trump

In his majority ruling, Chief Justice John Roberts stated, "The President, therefore, may not be prosecuted for exercising his core constitutional powers, and he is entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts.

"That immunity applies equally to all occupants of the Oval Office, regardless of politics, policy, or party."

The case played out exactly as I had predicted.

The Supreme Court has left it up to the lower courts to examine Trump’s actions, for which he is being charged, to determine whether those actions fall within the purview of the office of the president.

Now, I do believe the court will eventually rule against Trump in the election interference case, but this will all take some time to play out.

Special Counsel Jack Smith actually helped Trump by requesting additional time to package his case against Trump and develop his prosecutorial strategy.

The motion was not contested by Trump because it would free him up to campaign during the election.

Trump now has two worries.

First and foremost is winning this election, because there would likely be two positive outcomes from that.

As a sitting president, Donald Trump cannot be tried, so that would delay the case by four more years. A Trump AG could also just drop the case.

The second concern is that Judge Chutkan is forcing the case to start between the election and inauguration day just in case Trump wins the election.

He is not out of the woods just yet, but there is finally some significant daylight for Trump.

At this point, the key is that Trump can campaign and get to the election without any major legal bumps.

He will still have to deal with negative headlines from procedural hearings, but that is far better than facing a guilty verdict and jail sentence just before people head to the polls.
