Trump Seeks Extension in Classified Documents Case

Donald Trump caught a huge break in the classified documents case when Judge Aileen Cannon, who he appointed to the bench, tossed the case on the premise that Jack Smith’s appointment was illegal.

This means the case would be stalled because you knew Special Counsel Jack Smith would appeal.

Now Trump is asking the court to give him a 30-day extension on responding to Smith’s appeal, which would likely push the case well into next year.

Need More Time

Donald Trump clearly has a lot going on right now, and he is hoping the appeals court will listen.

In addition to this case and the election case, Donald Trump also has the Georgia case, the January 6 case, and the hush-money case all going.

His attorneys are arguing that he is getting hit from all sides, so he needs the extension to have enough time to answer the appeal filing.

According to early reports, Smith has not opposed the request, knowing at this point the likelihood of getting Trump into court for this case is not happening unless Trump loses the election anyway.

Besides, the appeals process is going to play out for quite some time.

If Smith wins the appeal, which is likely, Trump would then appeal to the Supreme Court, so this is months of legal work that has to be sorted out along the way.

As I have stated in previous reports, I was stunned that Cannon threw out the case on the basis that Smith was being appointed illegally.

This issue had been litigated thoroughly in the 1970s, with rules being set that have been followed ever since, giving the AG full authority to appoint a special counsel.

If the courts decide to uphold Cannon’s ruling, it would overturn the findings of every special counsel dating back to the Nixon era, and I just don’t see that happening.

It’s not as though this court is not opposed to turning over flawed precedents, as it did in Roe v. Wade, but the special counsel rule was even used during the Trump presidency with John Durham, so I just don’t see the argument here.

But again, this was all about moving the case beyond the election, and on that front, Trump’s legal team has done an amazing job.
