Smith Submits Filing with Judge Chutkan

The day has come, and Special Counsel Jack Smith and his prosecutors have dropped a massive filing on the case against Donald Trump.

Smith has to make a special request to get the filing approved because it is roughly four times the size of a normal filing of this type.

We are now waiting to see if the filing is released and just how damaging it will be for Trump.

The October Surprise

It seems as though in every presidential campaign, there is a bombshell that hits one candidate with the potential to derail the campaign.

In this case, that bombshell will be this filing by Smiht, which Trump’s defense team was unsuccessful in blocking.

The filing will reportedly contain evidence that has not yet been made public. Judge Chutkan will decide whether to publicize the information and how much of it.

Keep in mind that, to this point, Judge Chutkan has ruled against Trump’s legal team in just about every motion made, and she has also made it quite clear that she is not considering the election in any of her decisions.

Her only concern here is in keeping her case on track to get into the courtroom, as she has previously stated, “Defendant’s concern with the political consequences of these proceedings does not bear on the pretrial schedule.”

The superseding indictment filed by Smith after the Supreme Court made its immunity ruling did not change much, but Smith made it clear in his charges that Trump was either acting as a private citizen or a candidate.

As I have stated many times, the court's ruling only regurgitates previous rulings on this matter, and I do not believe that any of Trump’s actions that day will be viewed as falling under the purview of presidential duties that day.

That being the case, I do not believe any of the charges made by Smith will be immune from prosecution.

The question then becomes if Smith can actually get this case into a courtroom before inauguration day if Donald Trump wins this election, and that is going to be a rather significant challenge with the schedule as it currently is.

This filing could be harmful to Trump and provide the Harris campaign and the media with some bombs against Trump, so now this is a waiting game to see if Chutkan will release it before election day.
