Pam Bondi drops day one directives for Department of Justice
Pam Bondi was only recently confirmed as the Attorney General, but she hit the ground running.
Bondi laid out her primary objectives, but we can expect her to be challenged immediately by Democrats.
Bondi Drops the Hammer
Bondi issued a memo on her first day in office, which, in part, stated, “[T]he Department of Justice will ensure that, consistent with law, ‘sanctuary jurisdictions’ do not receive access to Federal funds from the Department.
“Consistent with applicable statutes, regulations, court orders, and terms, the Department of Justice shall pause the distribution of all funds until a review has been completed, terminate any agreements that are in violation of law or are the source of waste, fraud, or abuse, and initiate clawback or recoupment procedures, where appropriate.”
Her agenda is clearly immigration driven, which includes removing funding from sanctuary cities, which is the fight that I am most looking forward to considering immigration has always been considered a federal issue.
She will be able to carry out some of her agenda, but other aspects of it will be challenged, and some are likely to be outright defeated.
Reversing Biden death row commutations
Bondi stated that she wanted to roll back Joe Biden’s death row commutations, and while I support his, it will be very difficult for her to do.
She stated, "The commutations also robbed the victims' families of the justice promised — and fought hard to achieve — by the Department of Justice.
"The Department of Justice is directed to immediately commence the following actions to achieve justice for the victims' families of the 37 commuted murderers."
I think her time here would be better served going after the unprecedented preemptive pardons that Joe Biden issued, as there is no precedent for that, and I believe she could be successful in overturning those as well as establishing that you cannot be pardoned for a crime you have not yet been charged.
Sanctuary City Funding
The courts have been very clear that you cannot block funding that has been congressionally approved, especially when it is to achieve a political agenda, but this situation is a little different.
I say that because the courts have been clear except for very rare exceptions, immigration is a federal issue and federal law takes precedence over all else. The point being, how can a city or state legally harbor illegal immigrants by simply declaring itself a sanctuary city?
I can tell you flat out that Bondi’s efforts to halt funding to these cities and states will not be successful, but the real point, at least from my perspective, is to get the ball rolling so we can get this case before the Supreme Court.
This issue must be settled, but the court has sidestepped it in the past, kicking the cases back down to the lower courts. If Bondi does this properly, the court will have no choice but to finally take the issue up and settle it once and for all.
