Biden judge tries to stop CBP from doing its job
United States District Court Judge Jennifer Thurston is apparently trying to rewrite the rules on immigration.
The Biden-appointed judge just issued an order that would likely bring the CBP operations to a screeching halt.
Foot Pursuit
Before I get into the judge's order, I wanted to offer up a few reports that would not happen under her new order.
In August 2020, US Border Patrol agents tracked down six illegal immigrants and arrested them when they discovered a man at a local store was an illegal immigrant.
The report stated, “From narcotics arrests to fleeing illegal aliens, our Border Patrol agents are constantly observant and prepared for any scenario.
“This arrest of six subjects unlawfully present in the United States over the weekend truly reflects the Border Patrol’s commitment to keeping our communities safe and protecting our nation’s borders.”
Hundreds Arrested and Deported
Right after Trump took office, a massive campaign was underway to track down criminal illegals and remove them from the country.
White House Press Secretary updated the country on X, stating, "The Trump Administration arrested 538 illegal immigrant criminals including a suspected terrorist, four members of the Tren de Aragua gang, and several illegals convicted of sex crimes against minors."
Of those 538 people, 373 had serious criminal records, including crimes like rape.
When Trump was asked about the operation and the deportations, he stated, "Deportation is going very well. We're getting the bad, hard criminals out. These are people that have been as bad as you get, as bad as anybody you've seen. We're taking them out first."
Enter Judge Thurston
Thurston just threw a wrench into the system, stating that CBP can no longer make warrantless arrests, which is utterly ridiculous when you consider their job.
She ruled, “Border Patrol is enjoined from conducting detentive stops in this District unless, pre-stop, the detaining agent has reasonable suspicion that the person to be stopped is a noncitizen who is present within the United States in violation of U.S. immigration law, as required by the Fourth Amendment of the United States Constitution.
“Border Patrol is enjoined from effecting warrantless arrests in this District unless, pre-arrest, the arresting agent has probable cause to believe that the noncitizen being arrested is likely to escape before a warrant can be obtained, as required by 8 U.S.C. § 1357(a)(2).”
I would imagine that the administration is already planning to appeal the decision, but it is yet again an example of an activist on the bench rather than a juror, and by all accounts, that is all Biden appointed to the bench because most of them could not even answer the most basic legal questions during their hearings.
