Biden's Clemency During Christmas Leaves Families Distraught

In a significant pre-Christmas decision, President Joe Biden commuted the death sentences of dozens of inmates, leaving only three high-profile criminals on federal death row.

The sweeping clemency has stirred profound distress among the victims' families, including Alex Snell, whose sister's murderer was one of those spared, the New York Post reported. 

Detailed Breakdown of the Clemency Decision

The President's decision, executed just two days before Christmas, commuted the death sentences of 37 out of 40 federal inmates to life imprisonment without parole. This major judicial shift excluded notorious criminals such as Dzhokhar Tsarnaev, Robert Bowers, and Dylann Roof.

Among those granted clemency was Jorge Avila-Torrez, convicted of multiple horrific crimes including the murder of 20-year-old Amanda Snell. Avila-Torrez's criminal record includes the brutal sexual assaults and murders of young girls and a violent attack on a graduate student in 2010.

These clemency cases also highlighted systemic issues within the justice system, as evidenced by the wrongful imprisonment of Jerry Hobbs, accused and jailed for the murder of his daughter, who was later found to be another victim of Avila-Torrez. Hobbs spent five years in prison before his exoneration.

The Impact on Victims' Families

The families affected by these commuted sentences, particularly those who believed justice was served with the death penalty, were left in turmoil. Alex Snell, whose sister Amanda was one of Avila-Torrez’s victims, expressed strong opposition to the commutation.

"I’d rather see it go back to the way it was, where he was sentenced to death," said Snell. His statements mirror a broader sentiment of betrayal and loss among the families.

Snell further questioned the President’s decision on a personal level, reflecting a desire for more direct communication and justification from Biden himself.

“I want to have him explain to us, to our faces, why he chose to give them mercy when they didn’t give other people mercy,” Snell added, underscoring a deep need for closure and understanding.

Additionally, Snell criticized the perceived disparity in treatment between ordinary citizens and convicted criminals, arguing, “Why does he need to get special treatment? He’s just going to risk other people," pointing out safety concerns and potential risks posed by the decision.

Biden's Defense of His Decision

In defense of his clemency decision, President Biden cited his extensive experience in government and his moral stance against the death penalty. "But guided by my conscience and my experience as a public defender, chairman of the Senate Judiciary Committee, Vice President, and now President, I am more convinced than ever that we must stop the use of the death penalty at the federal level," explained Biden.

He emphasized his condemnation of the crimes and his empathy for the victims, stating, “Make no mistake: I condemn these murderers, grieve for the victims of their despicable acts, and ache for all the families who have suffered unimaginable and irreparable loss.”

Yet, he held firm on his belief that the death penalty should not be a tool in the federal justice system.

The clemency decision has not only affected the inmates and their families but has also reignited debates over the federal death penalty, balancing justice and mercy, and the effectiveness of the criminal justice system in the United States.
