Florida Leads Coalition Asking Supreme Court to Rule in Asylum Case

Florida Attorney General Ashley Moody is battling the Biden administration again.

She has been tireless in her fight, giving Biden just as many problems as Texas Attorney General Ken Paxton over the last few years.

Her latest battle is leading a massive coalition of red states to petition the Supreme Court in a multi-jurisdictional asylum case.

Let’s Dance

This is now the second time that Moody has led a significant coalition of states on a matter such as this.

In her previous effort, Moody led a coalition of 17 states over immigration rules that were changed by the Biden administration from the Trump administration.

In that case, a version of the Trump-era asylum ban was put in place by the Biden administration, which the Biden administration actually won, but instead it asked to enter into a settlement agreement.

In response, Ninth Circuit Judge Lawrence VanDyke stated, “The administration’s abrupt about-face makes no sense as a legal matter.

“Either it previously lied to this court by exaggerating the threat posed by vacating the rule, or it is now hiding the real reason it wants to hold this case in abeyance."

Now Moody is leading a 15-state coalition, stating, “Derelict President Biden and failed Border Czar Harris have been manipulative since day one in their plan to demolish our border.

“In fact, a federal judge in a Florida case even said that their actions were ‘akin to posting a flashing ‘come in, we're open' sign.' I, along with my colleagues, have once again filed a brief in support of intervenor states seeking to prevent collusive settlements between this administration and like-minded, open-border activist groups that are attempting to influence border-security policy behind closed doors.”

The brief to the court states, “In this case, the government has signaled that it is once again playing similar games.

“Specifically, the government has announced ‘settlement discussions’ with groups politically aligned with the current Administration regarding the Circumvention of Lawful Pathways Rule.

“And despite the risk of a collusive settlement, the Ninth Circuit denied the States’ motion to intervene to protect their distinct interest in stemming the tide of unlawful migration into this country over the southern border that the current Administration has let loose.”

The states joining Florida are Arkansas, Idaho, Indiana, Iowa, Kentucky, Mississippi, Nebraska, Ohio, South Carolina, South Dakota, Tennessee, Texas, Utah, and Wyoming.

This is a great move by Moody to keep immigration top of mind as we head into the final stretch of the election.

Biden recently clamped down on the border to get the numbers to the point that immigration was no longer making nightly headlines, but we cannot let people forget the damage that has been done to this county over the last three-plus years.
