Judge Boasberg’s Supreme Court ties scrutinized by Trump allies

Let the games begin, as they say…

With Donald Trump losing his battle against Judge Boasberg to deport hundreds of illegals who are allegedly gang members, his allies are now going after the reputation of Judge Boasberg, who was originally appointed to the bench by George W. Bush, then elevated by Obama, for his ties to Supreme Court Chief Justice John Roberts. 

Bring Them Back

When Trump sent planes to El Salvador with hundreds of alleged gang members, Judge Boasberg just about had a heart attack.

Boasberg ordered the planes turned out, but the administration claimed it was too late.

When Boasberg ordered all relevant documents delivered, Trump put him off, then the administration eventually stated that it was going to use the Alien Enemies Act of 1798 to legally justify the move.

Boasberg denied the administration, which Trump immediately appealed.

Appeal Denied

The case then went before the D.C. Circuit Court of Appeals, which, in a 2-1 ruling, found that Trump could not use the legislation.

Judges Karen LeCraft Henderson and Patricia Millett sided with Judge Boasberg’s motion, with only Judge Justin Walker, who Trump appointed, ruling in favor of the Trump administration.

Justice Millett stated, “There is neither jurisdiction nor reason for this court to interfere at this very preliminary stage or to allow the government to singlehandedly moot the Plaintiffs’ claims by immediately removing them beyond the reach of their lawyers or the court.”

This likely means the case is headed for the Supreme Court, but Trump’s allies are now intent on taking down Boasberg to paint him as an activist judge. To that point, note that they all call him an “Obama-appointed judge,” when it was actually George W. Bush who appointed Boasberg to the Superior Court of the District of Columbia in 2002, and Obama who elevated Boasberg in 2011 to the District Court of the District of Columbia.

Trump Allies Go After Boasberg

The attack against Boasberg has started, and Mike Davis, president of the Article III project, is leading the attack, stating, "The Chief Justice handpicked DC Obama Judge Jeb Boasberg to serve on the FISA court. The DC federal judges are in a cozy little club, and they protect their own."

Boasberg served on the FISA court in 2020, but notice now the attack ties in Supreme Court Chief Justice John Roberts, who has regularly crossed the aisle in decisions.

Trump also went after Boasberg, posting on Truth Social, "I’m just doing what the VOTERS wanted me to do. This judge, like many of the Crooked Judges’ I am forced to appear before, should be IMPEACHED!!! WE DON’T WANT VICIOUS, VIOLENT, AND DEMENTED CRIMINALS, MANY OF THEM DERANGED MURDERERS, IN OUR COUNTRY. MAKE AMERICA GREAT AGAIN!!!"

This is going to get uglier before it gets better, and if Trump loses this case at the Supreme Court level, expect bombs to be lobbed by MAGA and Trump’s supporters in Congress. I wish I had more input into how this will go before the Supreme Court, but this is a tough one because of the nature of the Alien Enemies Act. I really do want Trump to win this case, but my legal radar is not working on this one.
