Judge Denies Obamacare for DACA Recipients
Republicans have been pushing back against DACA from the very first day that Obama put the plan in motion.
Now, Dems are trying to get DACA on health care coverage at our expense, but a Trump-appointed judge just shot them down.
What is DACA
The Deferred Action for Childhood Arrivals (DACA) is a program that went operational when Barack Obama was in office.
In a nutshell, this gave protections to unaccompanied minors who entered this country illegally.
Those who were approved for the program were then able to file for work authorization, but they would have to renew their status every two years.
Over the years, Dems have tried to grow and expand the benefits of the program, but they have been fought every step of the way.
You Lie!
During Barack Obama’s 2012 State of the Union Address, Obama was famously called out as a liar when he said that DACA recipients would not receive healthcare benefits in this country.
Joe Biden proved Obama a liar this year when the White House announced in May that it was going to expand the rule for DACA to include healthcare benefits for some of the DACA participants.
The White House stated, “Thanks to the Biden-Harris Administration’s actions, today’s final rule will remove the prohibition on DACA recipients’ eligibility for Affordable Care Act coverage for the first time, and is projected to help more than 100,000 young people gain health insurance.
“Starting in November, DACA recipients can apply for coverage through HealthCare.gov and state-based marketplaces, where they may qualify for financial assistance to help them purchase quality health insurance. Four out of five consumers have found a plan for less than $10 a month, with millions saving an average of about $800 a year on their premiums.”
Denied
U.S. District Judge Daniel M. Traynor has just told the Biden administration to pump the brakes on giving away healthcare coverage to DACA participants.
In his ruling, in part, he stated, “The authority granted to CMS by the ACA is to ascertain whether an individual meets the requirements for lawful status. It by no means allows the agency to circumvent congressional authority and redefine the term ‘lawfully present.'”
The suit was led by Kansas GOP Attorney General Kris Kobach, who along with just about every red state in the country was fighting this new rule, Kobach stated, “Big win for the rule of law. Congress never intended that illegal aliens should receive Obama care benefits. Indeed, two laws prohibit them from receiving such benefits. The Biden administration tried to break those laws.”
The Biden administration will likely look to expedite an appeal because they know that once Trump goes into office, fighting this decision becomes moot.
