Judge in Trump deportation case says orders were signed ‘in the dark’
Donald Trump sending more than 300 illegals to El Salvador was the big immigration story last week.
The judge who tried to block the deportation is now going off the rails, accusing the Trump administration of signing orders in the middle of the night to avoid the deportation being challenged.
Ignore the Order
I have stated numerous times that I don’t have a problem with executive orders being challenged that fall outside the obvious realm of the president's powers.
Rather than allowing any president to go rogue, Democrat or Republican, I would rather see the order challenged to have the power defined.
However, in the case of Trump deporting a group of criminal illegal immigrants, I cannot even begin to understand how a judge can stop that, but that is what District Court Judge James Boasberg tried to do.
Even though the planes were already in the air, Boasberg ordered the administration to turn them around and bring these criminals back to the United States, but Trump laughed off the order.
Not the Way to Go
When Boasberg issued his injunction, Trump started to call for his impeachment. And while I agree that Boasberg was wrong, I have stated that a single ruling would never be enough to impeach any judge.
Chief Justice Roberts spoke on this as well, stating, "For more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision.
"The normal appellate review process exists for that purpose."
Again, I know it is not a popular opinion, but I am with Roberts on this one. But, I have also stated that I do not like the process when it comes to executive orders, and I would love to see our respective Judiciary Committees start to address this to streamline this process, possibly creating legislation that would allow any challenge of an executive order to be sent right to the Supreme Court for review.
Judge Fumes at Trump Orders
Last week, the administration had to appear before Boasberg to give timeline details regarding the deportation and flight, and he did not like what he saw.
Boasberg asked DOJ attorneys, "Why was this proclamation signed in the dark on Friday, early Saturday morning, and then these people rushed onto the planes? To me, the only reason to do that is if you know the problem, and you want to get them out of the country before a suit is filed."
I could not help but laugh at his question. It’s not that they think they are doing something wrong, but they already know every order will be challenged, so, yeah, sign it and get them out of here as quickly as possible before that challenge can be made. I have zero problem with what Trump did here solely because I don’t believe they acted outside their authority here.
To me, the only person overreaching is Boasberg. These are people who entered the country illegally. Many of these people were also hardened criminals and members of some of the most notorious gangs in the world. So, no, I have no empathy for their situation and never want to see them in this country again.
