Pennsylvania High Court Rejects Count Of Improperly Dated Mail Ballots

The Pennsylvania Supreme Court has issued a decisive ruling on the validity of mail ballots with incorrect dates. The court's recent decision asserts that mail ballots inaccurately dated must be excluded from the counting process in elections.The ruling was a response to a legal challenge initiated by the Republican National Committee. This came after it was noted that several counties were counting ballots despite them not adhering to date requirements stipulated by earlier court orders.

Republican National Committee Reacts to Court Decision

On Monday, the state’s highest court reinforced the need for strict compliance with election rules, delivering a 4-3 verdict. The counties affected by this ruling specifically include Bucks, Montgomery, and Philadelphia, all of which had been counting these disputed ballots.

RNC Chairman Michael Whatley commented on the court's decision, highlighting its significance. "Following our latest RNC lawsuit, today the Pennsylvania Supreme Court ruled yet again that undated ballots CANNOT BE COUNTED. No more excuses," he stated. "Election officials in Bucks, Montgomery, Philadelphia, and other counties have absolutely no choice but to reject illegal ballots. We will hold them to it."

Justices Emphasize the Importance of the Rule of Law

The court's justices expressed strong views on the adherence to legal norms and regulations by local officials. Justice David Wecht emphasized, “It is critical to the rule of law that individual counties and municipalities and their elected and appointed officials, like any other parties, obey orders of this Court.”

Justice Kevin Brobson also weighed in, stating, “Local election officials do not have the authority to ignore Election Code provisions that they believe are unconstitutional.” His statement underscores the judiciary's role in the interpretation and application of laws.

Impact on Recent Election Outcomes

Following this pivotal ruling, the Associated Press declared McCormick the winner over Casey in the election held on November 5. The verdict likely influenced the final vote tally, contributing to McCormick's victory by a margin of over 17,000 votes.

On November 1, prior to the election, the Pennsylvania Supreme Court had already affirmed the constitutionality of requiring mail ballots to have handwritten dates. This earlier decision set the precedent for the subsequent lawsuit and the final ruling on November 7.
