SCOTUS hands Trump win on nationwide injunctions
This week, the Supreme Court ruled on nationwide injunctions that were brought up regarding challenges to Trump’s birthright citizenship order.
The media and Dems are getting everyone whipped up, as though parts of the 14th Amendment have been shredded, but this ruling had nothing at all to do with that aspect of the executive order.
Birthright Citizenship
On January 20, 2025, Donald Trump introduced the “PROTECTING THE MEANING AND VALUE OF AMERICAN CITIZENSHIP” order.
While I never thought the order itself would be successful, I firmly support the points made in it, and I really do wish the Supreme Court would seriously look at this at some point.
The order wanted to exclude birthright citizenship for two very specific reasons: “(1) When that person’s mother was unlawfully present in the United States and the father was not a United States citizen or lawful permanent resident at the time of said person’s birth.
“Or (2) when that person’s mother’s presence in the United States at the time of said person’s birth was lawful but temporary (such as, but not limited to, visiting the United States under the auspices of the Visa Waiver Program or visiting on a student, work, or tourist visa) and the father was not a United States citizen or lawful permanent resident at the time of said person’s birth.”
HELP!
I have never supported the idea of someone illegally entering our country, having a child here, and that child being given citizenship. This loophole has literally created a human trafficking business where pregnant women come to this country solely to have their baby, so that baby is then entitled to American citizenship.
As expected, however, the courts rejected the order, with Judge Boasberg issuing a nationwide injunction on the case.
The Trump administration appealed the injunction, believing that the lower court was overstepping its bounds by doing so.
The Trump administration filed an appeal with the Supreme Court, with Trump posting, “STOP NATIONWIDE INJUNCTIONS NOW, BEFORE IT IS TOO LATE. If Justice Roberts and the United States Supreme Court do not fix this toxic and unprecedented situation IMMEDIATELY, our Country is in very serious trouble!"
Victory
On Friday, the Supreme Court agreed, limiting the ability of lower courts to issue nationwide injunctions with a 6-3 decision.
Justice Amy Coney Barrett issued a blistering opinion, ripping the mindset of the dissent, also stating, "The applications do not raise – and thus we do not address – the question whether the Executive Order violates the Citizenship Clause or Nationality Act. The issue before us is one of remedy: whether, under the Judiciary Act of 1789, federal courts have equitable authority to issue universal injunctions.
"A universal injunction can be justified only as an exercise of equitable authority, yet Congress has granted federal courts no such power.”
Now, I have seen Democrats and media personalities raging over this, but they are all pushing the narrative that Trump won the birthright citizenship issue, and that was not the case. It is sheer lunacy. It just reminds me of how the media interpreted the presidential immunity ruling, pushing a doomsday narrative rather than the truth about the ruling.
