Some January 6 Cases Being Dropped

The Supreme Court's decision to limit the scope of obstruction has had quite an impact on many of the January 6 cases still before the courts.

The sentences given in the cases that have already been prosecuted will now all have to be reviewed.

However, in terms of outstanding cases, prosecutors are being forced to drop charges because the new definition of obstruction no longer applies.

Drop Them

Prosecutors are now scrambling to re-present charges against some of the January 6 defendants.

In all, there were nearly 260 cases that were facing obstruction charges.

Several members of the Proud Boys, including Arthur Jackman, Edward George Jr., Paul Rae, and the father-and-son duo of Kevin and Nate Tuck, are among those charged with obstruction.

All of these men were recently offered plea deals with the obstruction charges removed from the list of charges.

Additionally, prosecutors have outright dropped the charges against other defendants.

So far, about 17 people have been convicted on obstruction charges alone, so each of these cases will have to be revisited to see if the charged would stick under the new guidelines issued by the Supreme Court.

In all, about 130 defendants were convicted on multiple counts, but obstruction was included in those cases.

The DOJ recently addressed this issue, stating that it “will be reviewing individual cases against the standards articulated in Fischer, as well as the anticipated ongoing proceedings related to Fischer in the D.C. Circuit, to determine whether the government will proceed with the charge.”

This has been a bit of a hot potato because Donald Trump has vowed to review these cases if elected and pardon as many of the J6 defendants as possible after taking office.

That, however, is a major mistake on his part, especially if Dems take back the House.

If Trump does that, he will be impeached for offering aid and comfort to an insurrectionist, offering a repeat of what we saw during his first term.

This is far from the last we have heard on this subject.
