Trump group sues Supreme Court Chief Justice Roberts

A group formed by top Trump adviser Stephen Miller has just declared war on SCOTUS Chief Justice John Roberts.

America First Legal Foundation (AFL) is attempting to pressure Roberts regarding what the White House perceives as judges acting as activists to hinder Trump from fulfilling his duties.

Trump slams judge

Trump has always enjoyed railing against judges who ruled against him, so it was no surprise when Trump was upset over the ruling that he could not use the Alien Enemies Act (AEA) to deport alleged gang members who were also illegals.

Trump posted to Truth Social, “Can it be so that Judges aren’t allowing the USA to Deport Criminals, including Murderers, out of our Country and back to where they came from?"

“If this is so, our Country, as we know it, is finished! Americans will have to get used to a very different, crime filled, LIFE. This is not what our Founders had in mind!!!”

To be clear, I agree that this issue needs to be addressed, but using AEA is not going to happen. This is a piece of wartime legislation, and as much as we would all love to see the issues at the border classified as an invasion, the courts are never going to agree that illegals coming over the border is an “invasion” by an enemy force justifying the use of this law.

Never defy SCOTUS

With Trump clearly not happy with all the recent court rulings against him, including a handful of decisions by the Supreme Court, he was recently asked if he would defy the Court the way he has with some of the lower court rulings.

When Trump was asked if he believes in the system and would adhere to the Court’s rulings, he responded, "Sure, I believe in the court system."

"I never defy the Supreme Court. I wouldn't do that. I'm a big believer in the Supreme Court, and have a lot of respect for the justices."

Even though the Supreme Court ruled that the administration needs to facilitate the return of Kilmar Abrego Garcia, the administration has yet to bring him back, which drew a slew of criticism from Democrats after Trump made those comments.

AFL suit

Earlier this week, AFL announced that it was suing Supreme Court Justice John Roberts, in what I can only define as a Hail Mary pass, as these cases are all headed to the Court.

The complaint, in part, states, "Under our constitutional tradition, accommodations with Congress are the province of the executive branch."

"The Judicial Conference and the Administrative Office are therefore executive agencies," and must therefore be overseen by the president, not the courts. This, to me, is a foolish move, poking the bear before appearing before the bear to ask for help.

I have been very clear that most of what Trump wants to do, I fully support, but the fact of the matter is that most of his orders circumvent the Constitution or go against existing laws, making these orders unconstitutional and illegal. However, most of these issues can be legislated by Congress, which is where our anger needs to be directed, not at the courts, regardless of the rhetoric coming from the White House. Sure, there are definitely activist judges out there, and I have pointed them out, but the majority of these rulings are simply following existing law, which is why Congress needs to address this with new legislation.
