Trump rocked by Supreme Court immigration ruling
Donald Trump and his administration are getting very frustrated over recent decisions by judges blocking his immigration moves.
Sadly, that does not appear as though it will change anytime soon.
Blocking Trump
Trump has encountered a gauntlet of Democratic-appointed judges over the course of the first few days of his administration.
The judge who has been the most challenging for Trump is Judge Boasberg, who was initially appointed by Bush and then elevated by Obama.
Even though the Court ruled that Boasberg did not have jurisdiction, his rulings are still impacting Trump in terms of the Alien Enemies Act (AEA) and possible contempt charges (the appellate court has just paused his proceedings, however).
Trump was hoping to get some relief from the Supreme Court, but the current reporting is not good news for Trump.
Dershowitz says Trump will be disappointed
One of Donald Trump’s recent suggestions is that American citizens could be deported to foreign countries for certain crimes.
This is a suggestion that went over well with nobody other than Trump’s most die-hard supporters, with numerous Republican allies of Trump’s already coming forward to push back against the idea.
On this subject, Dershowitz stated, “The writ of habeas corpus is constitutionally guaranteed. It can only be suspended under certain circumstances. So I don’t think this is going to end up the way President Trump wants it to end up."
“But he said, look, he’s going to explore the law. And if he calls me, I’ll tell him I think it’s unconstitutional. Maybe others would tell him it’s constitutional. And he tests the limits all the time."
Alito blasts court decision
The Supreme Court just blocked Donald Trump’s effort to deport illegals with an early Saturday morning ruling that has Justice Alito spitting fire.
Two Trump-appointed justices, Barrett and Kavanaugh, joined the liberal side of the bench to halt the deportations, with Alito responding, "[T]he Court issued unprecedented and legally questionable relief without giving the lower courts a chance to rule, without hearing from the opposing party, within eight hours of receiving the application, with dubious factual support for its order, and without providing any explanation for its order.”
He continued, "I refused to join the Court’s order because we had no good reason to think that, under the circumstances, issuing an order at midnight was necessary or appropriate.”
The biggest challenge for Trump is that he is now circumventing certain procedures, such as notifying individuals of the intent to deport, which would give them a chance to challenge the deportation. And before you ask, yes, even illegal immigrants are entitled to due process, regardless of the nefarious allegations made against them by the administration. We may not like it or agree with it, but it is the process currently in place.
