Trump Team Files Amicus Brief to Block Sale of Border Wall Materials
A report surfaced last week that the Biden administration was quietly selling off the remaining border wall materials before Joe left office.
The Trump legal team then immediately filed an amicus brief with the court to try to block the sale of the materials, but there is quite a bit to unpack here.
Biden Selling Off Border Wall Materials
About two weeks ago, a report surfaced on the Daily Wire that the Biden administration was very quietly selling off border wall construction supplies from “Nogales, Tucson, and Three Points,” all hotspots for illegal crossings.
The agent who came forward with the report stated that the administration was trying to get rid of as much as possible before the holiday.
The agent added, “When Trump comes back, and he wants to start the border wall all over again, the whole entire funding fight is gonna happen again. That’s their play. He’s gonna have to fight for this — again.”
The report, we would later find out, was not necessarily 100 percent accurate.
Trump Tries to Block Sale
Trump’s legal team wasted little time to take action here, immediately filing an amicus brief in support of blocking the sale of the equipment.
The brief, in part, stated, "The Court should issue an order directing the Defendants to immediately stop any ongoing sale of border-barrier materials to private parties pending the Court’s review of Defendant’s conduct, and the Court should swiftly conduct a searching examination of the Government’s conduct, by formal discovery if necessary, to examine the Government’s compliance with the law, the Constitution, and the Court’s injunction.”
The White House responded, "Through our reutilization, transfer and donation process, nearly 60% of those materials were transferred to authorized recipients, including U.S. Customs and Border Protection and the states of Texas and California. The remaining 40% was sold to GovPlanet under a competitive sales contract process beginning in June 2024. The material currently being sold through GovPlanet online auctions no longer belongs to the U.S. Government, and DOD has no legal authority to recall the material or stop further resale of material it no longer owns."
Jumping the Gun
When I heard what Trump was doing, I wondered why he had not reached out to Texas to get more information before taking such a big step. Had he done that, he would have learned two things.
First, when Lt. Gov. Dan Patrick checked out the materials that were going up for auction, he stated that most of the supplies were “junk” and would cost more to transport back to Texas than they were worth. Patrick had stated, "There were a few panels that might be usable but not worth the cost of shipping to Texas from Arizona.”
He later added that the auction itself was nothing more than a “ruse” to get the left excited about Biden sticking it to Trump on his way out the door.
To me, this makes Trump look a little silly for reacting to the headline before doing his due diligence on what was really happening here. Sadly, with all of our government officials, we are starting to see this far too many times.
