WI judge claims she has ‘absolute immunity’

The Wisconsin judge who was indicted for having obstructed justice during the attempted apprehension of an illegal immigrant is now taking a page out of Donald Trump’s playbook.

Milwaukee County Circuit Court Judge Hannah Dugan is claiming she has “absolute immunity” and the charges against her should be dismissed.

Indicted

Democrats have been livid over this arrest, as have more than 100 judges, who have petitioned the court to drop the charges against Dugan.

According to the initial filing, Dugan directed authorities to wait in one area while she directed the illegal immigrant and his attorney to leave through a more restricted area, trying to help the illegal immigrant avoid arrest.

The plan did not work, as the man was eventually arrested outside the courthouse after a foot chase, but a grand jury was presented with the case to see if prosecutors could secure an indictment against Dugan.

Earlier this month, the grand jury did indict Dugan, who is now facing up to six years in jail and a $350,000 fine.

Not Guilty

After her indictment, Dugan pleaded not guilty to the charges, claiming the system was being weaponized against her.

Protests erupted over her arrest, with one resident stating, “If we are going to go after judges, if we’re going to go after mayors, we have to understand that they can come after anybody.

“And that’s kind of why we wanted to make a presence out here today is to say that you can’t come after everyone and it stops here.”

If you can arrest a former president, what makes this judge above the law? From the evidence I have seen, she attempted to help a criminal evade law enforcement, and, to my knowledge, that is a violation of the law. She does not get a pass because she wears a robe.

Absolute Immunity

Dugan’s attorneys are now claiming that she should have judicial immunity for her official acts as a judge, which they are claiming this attempt to help someone evade arrest was. Now, I thought official acts would be ruling in cases, not misleading authorities to help someone escape arrest.

Assistant Secretary Dept. of Homeland Security Tricia McLaughlin pushed back, stating, “Since President Trump was inaugurated, activist judges have tried to obstruct President Trump and the American people’s mandate to make America safe and secure our homeland— but this judge’s actions to shield an accused violent criminal illegal alien from justice is shocking and shameful.”

This, to me, is an open-and-shut case, but we all know how the judiciary works these days.

My fear is that if the judge does not outright dismiss the case, Dugan is found guilty but the judge vacates the decision to protect one of their own. My understanding is that the judge assigned the case is anti-Trump, so I am not expecting a win, but it sure would be nice to see Dugan face the justice she deserves.
