Trump administration defies judge’s deportation order

Donald Trump has been challenged on just about every order he has issued, including the order to deport a group of illegal immigrants to El Salvador.

Some experts are now saying that the judge’s order may not have been legal, so Trump was not technically defying the order in the first place.

Another leak

Once again, Border Czar Tom Homan is fuming that there appears to be a leak in ICE or Homeland Security.

There were a lot of questions about how this legal battle got started when nobody was even supposed to know about the deportations.

Homan explained, “Again, information was leaked somehow. I don’t quite know how it got leaked. But there was a court, a mercy court hearing, on five, five people that were on schedule to be deported.

“The judge had a written order that said these five people can’t be removed right now. It wasn’t until this flight was already in international waters heading down to El Salvador that the judge made some comment about returning the flights.”

CNN: Trump may not have violated order

This is all now being litigated, with the judge claiming that Trump defied his order.

CNN senior legal analyst Elie Honig is now making the case that is not necessarily what happened. He explained, “They came right close to the line and maybe over it and let me give you the specific details we need to know in order to make this determination At the moment the judge gave the order, he said in court on Saturday afternoon, ‘I want you to not fly anyone out of here or if flights are already in the air I want you to turn them around.’

“At that very moment, where were the airplanes? If they were already on the ground in the United States, then yes, there was a defiance of the order. If they had already landed in El Salvador, then no, there was no defiance of the order, it was already too late," Honig said.

“If they are mid-flight, then we get into questions of where were they? Were they over American territory or international waters? And that’s some grey area. That may give the Trump administration something to hang their hat on.”

Not Enforceable

Judge James Boasberg was livid when the illegals were not returned, but the Trump administration argued that since the order was a verbal one, it was not enforceable.

Boasberg responded, “You felt that you could disregard it because it wasn’t in the written order. That’s your first argument. The idea that because my written order was pithier it could be disregarded, that’s one heck of a stretch, I think.”

Attorney General Pam Bondi stood behind the decision, stating, “These are foreign terrorists. The president has identified them and designated them as such — and we will continue to follow the Alien Enemies Act.”

I have reported previously that I don’t mind Trump’s orders being challenged because I think we need to find out just how far presidential powers go, but this is not one of these cases. These were hardened criminals, many of them members of two of the most notorious gangs in the world, and this judge wanted to bring them back rather than deport them. I just don’t understand where this even needs to be litigated, let alone a judge blocked the decision by the government to deport illegal immigrant criminals. But then again, these are the same people who built a monument to George Floyd, so that pretty much explains everything.
