Trump suffers series of legal setbacks in court

Donald Trump has faced a lot of challenges during this term, with virtually every order issued being fought.  

While he recently had a decent run in the courts, that was halted this week after three consecutive rulings came down against him.  

Trump Education Reform Agenda at Risk 

Donald Trump made it quite clear during the election that he wanted to significantly scale back the Department of Education, if not eliminate it altogether.  

The plan to dismantle the department was announced in March, but it was immediately challenged.  

This week, a federal appeals court declined to put a halt to a district judge’s decision to block the Trump administration’s plan, ruling, "What is at stake in this case, the District Court found, was whether a nearly half-century-old cabinet department would be permitted to carry out its statutorily assigned functions or prevented from doing so by a mass termination of employees aimed at implementing the effective closure of that department. 

"Given the extensive findings made by the District Court and the absence of any contrary evidence having been submitted by the appellants, we conclude that the appellants' stay motion does not warrant our interfering with the ordinary course of appellate adjudication in the face of what the record indicates would be the apparent consequences of our doing so. The appellants' motion for a stay is denied." 

Deportation Blocked 

After the terror attack in Colorado, the Trump administration had also hoped to deport the family of the suspect in the attack, but that too was blocked. 

DHS Secretary Noem posted, "Mohamed's despicable actions will be prosecuted to the fullest extent of the law, but we're also investigating to what extent his family knew about this horrific attack. If they had any knowledge of it or if they provided any support to it." 

A temporary restraining order (TRO) was issued by U.S. District Judge Gordon P. Gallagher, a Biden judge, to block authorities from removing those family members.  

Gallagher wrote, "Defendants are temporarily restrained and enjoined from removing Hayem El Gamal and her five minor children from the State of Colorado or the United States.” 

Boasberg Rules Migrants Can Challenge Removals 

Judge Boasberg was also back in the news, and I have to admit, I am quite confused he has anything to say at this point considering the Supreme Court ruled that the case filed in his court was filed in the wrong jurisdiction.  

Even so, he announced this week that the migrants Trump was trying to deport due to gang affiliations can challenge the administration. He stated, "In short, the Government must facilitate the Class’s ability to seek habeas relief to contest their removal under the Act. 

“Exactly what such facilitation must entail will be determined in future proceedings. Although the Court is mindful that such a remedy may implicate sensitive diplomatic or national-security concerns within the exclusive province of the Executive Branch, it also has a constitutional duty to provide a remedy that will ‘make good the wrong done.’" 

Trump is going to lose any case related to due process, as our Constitution does not require you to be a citizen to enjoy this right. This is exactly why I thought Trump would never come close to meeting his desire to deport the more than nine million illegals who entered this country during Biden’s term.
