Judge blocks Habba appointment
Well, my friends, it would appear that the deep state or activist judges, whatever you prefer, is at it again, at least in the eyes of the Trump administration.
Yet again, Donald Trump is being derailed by a Democrat-appointed judge.
This time, it is regarding the appointment of Alina Habba as the United States Attorney for the District of New Jersey.
She’s My Gal
Habba, while not the best attorney, in my opinion, has been a loyal soldier for Trump, and if you are loyal to Trump, he rewards you.
For Habba, it was a juicy appointment as the Acting US Attorney in New Jersey.
The problem was that Trump had to rely on a judicial panel to extend her because there is no way Habba would get the support she needed in Congress.
When it came time to renew Habba, the panel rejected her and instead chose her first assistant, Desiree Grace, for the role.
Not on My Watch
After the panel appointed Grace, she immediately stated she would accept the position, at which point Attorney General Pam Bondi stepped in.
Bondi fired Grace, saying the administration would not be bullied by activist judges. Habba was then reinstated to the position.
Sens. Cory Booker (D-NJ) and Andy Kim (D-NJ) went ballistic, stating, “Trump’s Department of Justice is once again criticizing a court that acted within its authority, continuing a pattern of publicly undermining judicial decisions and showing disregard for the rule of law and the separation of powers.”
Their statement continued, “The firing of a career public servant, lawfully appointed by the court, is another blatant attempt to intimidate anyone who doesn’t agree with them and undermine judicial independence."
She’s Out… Again
U.S. District Judge Matthew Brann, appointed by former President Barack Obama, offered the same fate to Habba that the panel did, but he added a little cherry on top, saying the appointment was illegal, stating, “Faced with the question of whether Ms. Habba is lawfully performing the functions and duties of the office of the United States Attorney for the District of New Jersey, I conclude that she is not.”
Habba then responded, “It’s disturbing, what we’re seeing. And Pam Bondi called it like it is. The attorney general said it today. We will not fall to rogue judges. We will not fall to people trying to be political when they should just be doing their job: respecting the president. And you can’t get rid of the president.”
She further stated, “I am the pick of the president. I am the pick of Pam Bondi, our attorney general, and I will serve this country like I have for the last several years, in any capacity.”
I wish I had an answer to tell you that was positive, but I don’t have enough legal expertise to address how this will possibly unfold. From what I have read, Trump does not really have a strong position here, but you just never know these days. Regardless, we will find out soon enough because you know Trump will litigate this all the way to the Supreme Court if he has to.
